If animal testing takes place in your company, it is necessary to appoint a person as animal welfare officer and report this to the responsible authority.

As the operator of an institution or as the person responsible for a business in which animal experiments are carried out or in which tissue and organs are removed from animals for scientific purposes, you must appoint an animal welfare officer and a deputy and report them to the responsible authority.

Animal Welfare Officer:

• An animal welfare officer and the deputy must have the necessary expertise and reliability.
• The expertise must be demonstrated by a university degree certificate in veterinary medicine and the corresponding knowledge or skills.
• The animal welfare officer is obliged to keep his or her knowledge and skills up to date with the latest scientific findings through regular training.
• The animal welfare officer may not at the same time be responsible for animal experiments carried out by the animal welfare officer.

As the owner of the facility or as the person responsible for such a business, you must ensure in an instruction that the animal welfare officer is not subject to instructions when carrying out their duties. They may not be disadvantaged because of the performance of their duties. You regulate their position and powers through a statute, an internal company instruction or in a similar form.

A special permit is subject to a fee. The amount of the costs depends on the respective processing effort.

You must notify the animal welfare officer and his/her deputy before the facility begins its activities.

• If the animal welfare officer does not have a university degree in veterinary medicine, you can apply for an exemption with an appropriate justification.
• The animal welfare officer to be appointed must have the necessary knowledge and skills in order for you to receive the exemption.
