The building encumbrance information or the copy of the building encumbrance register informs you whether a property is benefited or encumbered by public law obligations.

If a building burden is registered for your property, you have an obligation to do, tolerate or refrain from doing certain things that affect the property.

Building encumbrances affect the value of a property. In order to finance the property, your bank needs current information from the building encumbrance register.

The building encumbrance information or copy of the building encumbrance register provides information about which public law obligations (building encumbrances) are entered in the building encumbrance register.

These may be building burdens that impair the structural usability of the property (for example, taking over a setback area or a parking space) or improve it (for example, unification building burden).

You can obtain extracts from the building encumbrance register from the State Office for Geoinformation and Surveying.

To establish or delete building encumbrances, please contact the responsible building inspection office of your district office.

Erforderliche Unterlagen

For excerpts from the building encumbrance register with personal data, the following evidence is required for data protection reasons:
  • a credential or
  • A power of attorney from the landowner or the person entitled to leasehold buildings (see Power of Attorney link)

Voraussetzungen

You will receive extracts with owner details
  • if you own the property,
  • as leaseholders, authorized representatives and notaries or
  • if you have a legitimate interest in the information.

Kosten

The amount of the costs depends on the number of parcels for which information is requested.

Verfahrensablauf

On-line:
  • You access the online service.
  • The necessary steps to request the information will be explained later.
  • The applicable fees are paid by credit card or direct debit.
E-mail, fax or letter:
  • E-mail, fax or letter: The owner of a property, the holder of the leasehold or an authorized person creates an order.
  • The documents are then sent together with the fee notice as PDF files by email or in paper form by post.
