Anyone using new or renewed measuring devices must notify the competent verification office no later than six weeks after commissioning.

With the new Measurement and Verification Act, the previous initial verification of measuring devices no longer applies. As a result, the verification authorities no longer have any knowledge of the location of the measuring devices used. To ensure that effective market surveillance in terms of consumer protection is possible as before, the legislator has introduced the obligation to notify.

Anyone using new or renewed measuring devices must notify the competent authority in accordance with state law no later than six weeks after commissioning. The following information must be provided

• the type of device
• the manufacturer,
• the type designation,
• the year of marking of the measuring device and
• the address of the person using the measuring instrument.

Measuring instruments are all devices or systems with a measuring function that are intended for use in commercial or official transactions or for carrying out measurements in the public interest. For example, if strawberries are sold by weight or gas by volume, these are measuring instruments within the meaning of MessEG and MessEV. However, certain areas of application are excluded.

The obligation to notify only applies to new or renewed measuring devices that are put into operation after 01.01.2015. Measuring devices that were already in use before 01.01.2015 only have to be reported when they are renewed.

If a measuring device that has already been put into operation has been changed so significantly that a new conformity assessment must be carried out instead of verification (the decision is made by the verification authority), then this measuring device is considered to be renewed. A renewed measuring device is equivalent to a new measuring device and must also be reported (again).

If you use several measuring devices of the same type, you do not have to report each individual measuring device. According to § 32 Para. 2 MessEG, the notification can also be made by the user:

• informs or arranges to be informed of which types of measuring device he is using no later than six weeks after commissioning the first measuring device of a type of measuring device and
• ensures that overviews of the measuring instruments used containing the following information are made available to the competent verification office immediately upon request:
• • the device type,
  • the manufacturer
  • the type designation
  • the year of marking of the measuring instrument and
  • the address of the person using the measuring instrument.

The notification obligation can be fulfilled electronically (see "Online procedure"). The verification offices confirm receipt of the notification.

If the notification is not made, not made correctly, not made in full or not made in good time, this constitutes an administrative offense under the MessEG and can be punished with a fine.

In principle, all measuring devices used must be notified in accordance with the MessEG and MessEV. The obligation to notify does not apply to measuring standards such as weights or dispensing measures and not to additional equipment.
