As an employer/user, you must notify the competent authority of the use of certain particularly hazardous biocidal products.
As an employer/user, you are obliged to notify the Occupational Health and Safety Office in writing or electronically at least six weeks before the start of use,
a) if biocidal products are used in the company,
1. which are classified
a) as acutely toxic cat. 1, 2 or 3,
b) carcinogenic, germ cell mutagenic or toxic to reproduction Cat. 1A or 1B or
c) specifically target organ toxic Cat. 1 SE or RE
2. for which, in addition to the cases covered by number 1, the use category "trained professional user" has been specified in the authorization.
b) if the use of biocidal products is for the first time and the beginning of a renewed use of biocidal products after an interruption of more than one year.
Identification document (copy of the identification document)
Copy of the certificate(s) of competence or other corresponding qualifications in accordance with Annex I Section 4.4 (2) of the Hazardous Substances Ordinance (GefStoffV) of all competent persons
If applicable, copy of the certificate(s) of attendance of the most recently attended further training event(s) in accordance with Annex I Section 4.4 (5) GefStoffV of all competent persons if certificates of competence are older than 6 years.
Biocidal products may only be used by persons who have the relevant expertise for the biocidal product in question. The requirements for expertise depend on the type of product, the applications for which the biocidal product is approved and the potential risk to humans and the environment.
Fees under state law: Ordinance on fees and expenses for official acts and services (General Fee Schedule-AllGO)
For biocidal products that could be used without specialist knowledge under the old version of the GefStoffV and that require specialist knowledge under the new version of the GefStoffV, the specialist knowledge requirement under Section 25 GefStoffV will only apply from July 28, 2025.
The determination of submitted arthropods (insects and arachnids) is carried out by the Pest Control Department of the Lower Saxony State Office for Consumer Protection and Food Safety for Lower Saxony offices and authorities on an administrative assistance basis. A fee is charged for all other senders, such as professional pest controllers or private individuals.

Responsibility lies with the property owner. Private property owners must contact private pest controllers. Responsibility for municipal properties lies with the respective municipalities.
