The construction of certain buildings and other structures in residential and commercial areas is possible in individual cases without a building permit and can be reported within the framework of a notification procedure.

Which buildings and other structures are permit-free construction measures and require written notification under which conditions is regulated in § 62 of the Lower Saxony Building Code (NBauO).

Since no building permit is granted, the building owner, together with the draftsman, is responsible for complying with all the requirements that the construction project must meet.

The building owner may request that a building permit procedure be carried out instead of a notification procedure. There are higher fees in the building permit process and the processing time is usually longer.

Documents are required. These depend on the type of construction project. The draftsman knows which building documents have to be submitted for the construction project.

The necessary documents should be submitted in duplicate.

Further requirements are placed on the draftsman, for example with regard to qualifications and sufficient insurance coverage. The structural engineer must also have a special qualification in accordance with Section 65 (4) of the Lower Saxony Building Code (NBauO).

Instead of submitting a building application, the client submits a signed notification of the intended construction project to the competent authority. This must be accompanied by the building documents signed by the draftsman.
Insofar as an examination of the structural evidence or the suitability of the escape routes is required, these documents can be attached to the other building documents or submitted separately to the building supervisory authority.

Construction may begin as soon as confirmation from the competent authority that the development is secured and, if necessary, confirmation of the suitability of the client's escape routes has been obtained.

This certificate must be issued by the competent authority within one month of receipt of the documents.

If there is any doubt as to whether an intended construction project requires a building permit or not, information can be obtained from the competent authority before the measure is carried out. Certain construction measures are non-procedural construction measures and do not require notification.

The responsibility lies with the municipality, the joint municipality and the city. After review, the latter forwards the notification to the lower building supervisory authority for processing.
