The permit may only be issued if the person responsible for the activity has the specialist knowledge and skills required for the activity based on their training or previous professional or other contact with animals. Proof of this must be provided to the competent authority in a technical interview on request.
In addition, the person responsible for the activity must have the necessary reliability.
Suitable premises and equipment must be available in the facilities and businesses used for the activity and sufficient competent personnel must be available to ensure that the animals are kept in accordance with the requirements of the Animal Welfare Act.
It must be ensured that the persons entrusted with the care and/or killing of the animals can prove at all times that they have the knowledge and skills specified in the Animal Welfare Experimental Animal Ordinance.
It must be possible to expect that the applicant will meet his organizational obligations (Section 4 of the Ordinance on the Protection of Animals used for Experimental Purposes - TierSchVersV), appoint an animal welfare officer (Section5 TierSchVersV), set up an animal welfare committee (§ 6 TierSchVersV), comply with its recording obligations (§ 7 and 8 TierSchVersV) and meet the requirements for the identification of dogs, cats and primates (§ 9 TierSchVersV).
In the case of primate breeding, the breeder must have a concept in place to increase the proportion of animals that are the offspring of primates bred in captivity.

The LAVES will decide in writing or electronically on the application for a permit within a period of four months from receipt of the application. The time limit may be extended by the LAVES by up to two months if this is justified by the scope and difficulty of checking whether the requirements for the permit have been met.
When calculating the time limit, periods during which the applicant has not complied with the requirements for the granting of a permit set out in the Animal Welfare Experimental Animal Ordinance despite written or electronic requests from the LAVES shall not be taken into account.
The activity (breeding, keeping, use of vertebrates or cephalopods) may only commence after the permit has been issued.
