The construction and modification of residential buildings of building classes 1 – 3 (i.e. the floor of no floor in which recreation rooms are possible may be on average more than 7 m above the ground surface), including their ancillary buildings and ancillary facilities as well as building-independent systems for the use of solar radiation energy, does not require a building permit if:
- the project is within the scope of a qualified development plan or a project-related development plan,
- the project complies with the provisions of this development plan, and
- the development is secured.
This does not apply, among other things, if the municipality declares that a building permit procedure is to be carried out.
In the case of projects such as residential buildings of building class 4 up to the high-rise boundary that meet the above-mentioned requirements, the exemption procedure will be carried out at the request of the building owner.
The construction documents, which must be signed by the building owner and, in the case of construction documents, by a design author authorised to submit a building proposal, must be submitted to the municipal administration or the municipal administration. The details of these construction documents are set out in the State Ordinance on Construction Documents and Structural Inspection.
The project may begin one month after submission of the necessary construction documents to the municipal administration or municipal administration, unless the municipality declares within this period that a building permit procedure is to be carried out.
