Technical rule for hazardous substances 'Pest control with very toxic, toxic and harmful substances and preparations (TRGS 523)

If you wish to carry out pest control activities with substances and mixtures classified as acutely toxic category 1 to 4 or specifically target organ toxic category 1 or 2 or with mixtures in which the above substances are released, or if you wish to resume such activities after an interruption of more than one year, you must notify the competent authority at least six weeks before commencing the first activity.

If the control is not already regulated by other legal provisions, the Hazardous Substances Ordinance requires notification if you

• professionally with others or
• not only occasionally and to a small extent in your own business in which food is produced, treated or circulated or
• in a facility or community facility 2 that is named in the Infection Protection Act, such as
  • z. e.g. in schools, day care centers, asylum centers or prisons or
  • z. e.g. in hospitals, day clinics and maternity facilities

wish to carry out pest control measures involving the use of pesticides that are marketable - depending on the application case

1. as biocidal products in accordance with Section II a of the Chemicals Act or

2. as plant protection products according to the Plant Protection Act.

^{2 Community facilities within the meaning of the Infection Protection Act are facilities in which predominantly infants, children or adolescents are cared for, in particular crèches, kindergartens, day care centers, day nurseries, schools or other educational institutions, homes, vacation camps and similar facilities.}

The notification must contain the following information in particular:

1. proof that the company's personnel, premises and safety equipment are sufficiently suitable for this work,
2. the number of persons handling the pesticides,
3. the pesticides intended to be used for pest control, the
   1. designations,
   2. properties,
   3. mechanisms of action,
   4. application methods and
   5. decontamination processes,
4. the areas of the intended pest control and the target organisms against which the pest control is to be carried out, and
5. the result of the substitution test in accordance with the Hazardous Substances Ordinance

Pest control must be carried out in such a way that people and the environment are not endangered.

The company or the pest controller must have a sufficient number of suitable and competent persons.

A person is suitable if they:

• is at least 18 years old,
• has the necessary reliability for handling pesticides,
• can prove that he or she is physically and mentally fit to handle pesticides by means of a certificate from a doctor with the title "occupational medicine" or the additional title "occupational medicine"; the certificate must not be older than five years,
• has sufficient command of the German language.

A person is considered competent if they have passed the examination

• to become a pest controller or
• for the recognized qualification of certified pest controller or
• as an assistant or master pest controller under the law no longer in force in the Federal Republic of Germany or under the law of the former GDR

and undergoes regular further training.

Anyone who has passed an examination or successfully completed training that has been recognized by the competent authority as equivalent to the above-mentioned examinations is also deemed to be competent.

There are no fees for the notification of pest control measures.

Your application will be processed as soon as we receive it.

The notification must be submitted to the competent authority at least six weeks before the start of the first activity.

The use of auxiliary staff requires that they are only deployed under the direct and constant supervision of a competent person and that they are demonstrably instructed regularly in accordance with their activities.

In the case of pest control, approval and authorization requirements as well as restrictions on use in accordance with other legal regulations must also be observed (e.g. Plant Protection Act, Infection Protection Act).

In the case of officially ordered measures for disinfection and the control of pests in accordance with the Infection Protection Act, please contact the health authority responsible for the respective district or independent city.
