If you are a veterinarian, you are allowed to carry out your activity in Germany as a service provider for the temporary and occasional practice of the profession even without a license or permit. However, you must report this to the competent authority.
Veterinarians who are
- are nationals of an EU member state or of another state party to the Agreement on the European Economic Area or of a state with which an EU association agreement has entered into force, and
- are authorized to practice the veterinary profession outside Germany in one of these states and are legally established there as a veterinarian,
may practice the profession in Germany as a service provider within the meaning of the provisions of the Treaty on the Functioning of the European Union (TFEU) for the temporary and occasional practice of the profession even without a license or permit.
In this case, you are subject to a prior written notification obligation pursuant to Section 11a (2) of the Federal Veterinary Medical Regulations. The obligation to register exists if you move from another member state to Germany for the first time in order to provide services. The notification must be renewed once a year if you intend to temporarily and occasionally provide services in Germany during the year in question. If prior notification is not possible due to the urgency of the activity, the notification must be made immediately after the service has been provided.
To provide services for the first time or if there is a significant change from the situation certified in the documents, you must submit the following documents in accordance with § 11a Paragraph 2 Sentence 4 of the Federal Veterinary Medical Regulations:
- Proof of citizenship,
- Certificate stating that you are legally established as a veterinarian in a member state of the EU or in another state party to the Agreement on the European Economic Area or in a state party to the Agreement on the European Economic Area to which Germany and the EU have granted a corresponding legal right by treaty and that the practice of the profession is not prohibited, even temporarily, at the time of submission of the certificate, and
- Your professional qualification certificate.
The certificates must not be older than twelve months at the time they are submitted. You may also be required to provide information regarding details of your insurance coverage or other type of individual or collective protection related to professional liability.
Translations in German must be provided of documents and certificates written in foreign languages, unless the State Veterinary Chamber allows otherwise. The State Veterinary Chamber may require that the translations have been made by a publicly appointed or sworn interpreter or translator.
You must be legally established to practice veterinary medicine in another EU member state or one of the states listed above.
You can make the notification to the competent body in any form, enclosing the required documents (see below). You will receive a confirmation from the competent body that the notification has been properly made.
The processing time depends on the completeness and suitability of the submitted documents (see above).
The notification must be made before starting to practice the profession. If prior notification is not possible due to the urgency of the activity, you must make the notification immediately after providing the service.
As a service provider within the meaning of the TFEU, you have the same rights and obligations with regard to the exercise of your profession as members of the State Veterinary Chamber of Thuringia, in particular the rights and obligations to practice your profession conscientiously, to undergo further training, to participate in emergency services and to provide documentation, as well as the obligation to recognize the professional, statutory or administrative rules of professional conduct in accordance with Article 5 (3) of Directive 2005/36/EC. The professional regulations of the State Veterinary Chamber of Thuringia apply to you accordingly.
The service is provided under the professional title of "veterinary surgeon" or "veterinarian".
You must have the necessary knowledge of the German language to perform the service.
In case of disputes between members of the profession as well as between them and third parties, which have arisen from the practice of the profession, the arbitration committee of the State Veterinary Chamber of Thuringia can be called upon.
- Nationals of an EU member state or EEA state who are legally established as a veterinarian outside Germany in one of these states may practice the profession in Germany as a service provider in the sense of temporarily and occasionally even without a license or permit if they have complied with the prior written notification requirement.
- Certain evidence must be provided.
