Anyone who uses biocidal products must do so properly. It is necessary to report this use to the competent authority upon commencement or resumption after a break of at least one year.

Pest control for the destruction of pests must be carried out in such a way that people and the environment are not endangered.

Anyone who carries out pest control

• carries out pest control on a professional basis for others or
• not only occasionally and to a small extent in their own business in which food is produced, treated or placed on the market, or
• wants to carry out pest control in a facility or
• wishes to resume his activity after an interruption of more than one year must notify the competent authority in writing before commencing his activity.

The employer must enclose the following with the permit application:

• a description of the intended areas of application of fumigation,
• details of the active substances to be used,
• proof that the company's premises and safety equipment are sufficient and suitable for the planned fumigation,
• information on the number
  • of employees who are to carry out the intended fumigation,
  • the competent persons,
  • the holders of the certificate of competence and
• copies of the certificates of competence of the competent persons and the certificates of competence of the holders of the certificates of competence.

Before carrying out pest control, you must provide proof of sufficient staffing with the notification. This is the case if suitable competent persons are employed.

Suitable persons are those who

• is at least 18 years old,
• possess the reliability required for handling pesticides and
• can prove their physical or mental aptitude for handling pesticides by means of a certificate from a doctor in accordance with Section 7 paragraph of the Occupational Health Care Ordinance (the certificate must not be older than five years).

Competent persons are those who

• has passed the examination to become a pest controller or
• the examination for the recognized qualification "Certified Pest Controller" or
• has passed the examination to become an assistant or master pest controller under the law no longer in force in the old federal states or under the law of the former GDR and
• undergoes regular further training.

Anyone who has passed an examination or successfully completed training that has been recognized by the competent authority as equivalent to the aforementioned examinations is also deemed to be competent.

If the intended pest control is limited to certain areas of application, anyone who has passed an examination or successfully completed training that has been recognized by the competent authority as suitable for these activities shall also be considered competent.

No fees are payable for the notification of pest control measures. The recognition of the equivalence of expertise is subject to a fee.

The notification must be made by the pest control company wishing to carry out pest control for the first time or after an interruption of more than one year.

As this is an area that is only regulated by national law, proof of comparable expertise from another member state of the European Community requires an equivalence assessment of the expertise, which also includes knowledge of the relevant national legal regulations. The TMASGFF is responsible for the recognition of an equivalent examination or training and the recognition of a suitable examination or training.
For pest control of vertebrates, a certificate of competence in accordance with the Animal Welfare Act on the knowledge and skills required to kill vertebrates is also required.

• Professional pest control: Notification of first-time commencement of activities or after an interruption of more than one year
• Professional pest control must be notified to the competent authority.
• Written application with required documents must be submitted.
• Responsible: the locally responsible regional inspectorate of Department 6 Occupational Health and Safety of the Thuringian State Office for Consumer Protection.
