§Section 13 (1) ProstSchG

Note: Depends on the respective administrative fee schedule of the state or on the fee statutes of the authorities responsible under state law.

If you wish to have a prostitution business operated by a deputy, you as the operator require a deputy permit.

If you wish to operate a prostitution business through a person appointed as a proxy, you will need a proxy permit.

You can operate your prostitution business through one or more persons appointed as a proxy. To do this, you must apply for a prostitution permit for each person appointed as a prostitute.

The proxy permit is issued to the operator for the person appointed as a proxy. It can be issued for a limited period.

The person appointed as a substitute is also subject to a background check.

• If applicable, permission in accordance with Section 12 of the Prostitute Protection Act (ProstSchG) of the operator of the prostitution business
• Copy of a valid proof of identity of the prostitute
• Copy of the representative's residence permit, if applicable
• Certificate of good conduct for submission to an authority about the prostitute
• Extract from the central trade register for the prostitute
• Certificate in tax matters from the relevant tax office for the deputy
• Certificate from the insolvency court, if applicable

• Valid permit or corresponding proof of application for an application to operate a prostitution business
• Note 1: For administrative reasons, it is possible to apply for a permit under Section 12 ProstSchG and a prostitution license under Section 13 ProstSchG at the same time.
• Note 2: The prerequisite for the granting of a proxy permit remains the granting of a permit in accordance with Section 12 ProstSchG.
• Minimum age of 18 years for the person designated as a deputy
• The deputy must agree to the background check for processing.

You submit the application for a substitution permit to the competent authority.

The competent authority checks the documents and carries out a background check on the person intended to act as a deputy. Their cooperation is required for this.

If the check is positive, the competent authority will issue the replacement permit.

If the documents are complete, the application will be processed promptly.

Before the prostitution business is operated by a proxy, you must have a corresponding permit. It is therefore necessary to submit an application in good time.

If the prostitution business is no longer operated by the person appointed as a prostitute, you must notify the competent authority immediately.
