§§ Sections 48, 49 of the Passenger Transportation Act (PBefG)

If you wish to carry more than nine passengers in national transport outside of scheduled services (occasional transport, e.g. rental bus services, excursions or vacation destinations), you will require a permit.

If you wish to transport more than nine people in Germany by motor vehicle outside of scheduled services (occasional services), you will require a permit. This is issued for the intended type of transport (rental bus transport, excursion trips or vacation destination trips).

Formal application:

• Name and place of residence and business,
• for natural persons, date and place of birth,
• Start and end of the requested period of validity,
• Information on the number, type and capacity (number of seats) of the vehicles to be used.

Supplementary application documents and proof that the licensing requirements pursuant to Section 13 PBefG have been met:

• Certificate of good conduct,
• Extract from the central trade register,
• Clearance certificates from the social insurance institutions, the employers' liability insurance association, the tax office and the municipality regarding the proper payment of taxes,
• Proof of financial standing and the IHK certificate of competence.

Applicants must

• personally reliable
• financially capable and
• be professionally qualified.

The fee is calculated on the basis of the Cost Ordinance for Official Acts in Paid or Commercial Passenger Transport by Motor Vehicle (PBefGKostV).

Basis of the fee calculation:

• Number of vehicles
• the term of the permit

• Application by submitting the application form and the required supplementary application documents,
• Examination of the application,
• Initiation of the hearing procedure with the participation of the Chamber of Industry and Commerce, LRÄ, in particular the lower transport authorities, the trade associations, the Office for Occupational Health and Safety, etc.
• Granting of the permit by means of an official decision; once the permit has become legally binding, the permit certificates are handed over.

The processing time is usually four to six weeks.

A decision on the application must be made within 3 months. This period can be extended by a further 3 months.
