If you want to access a property from a federal highway, you need an access road. This requires a separate permit in order to influence the flowing traffic as little as possible.

If you want to create or change a driveway, the responsible authority checks:

1. whether you are allowed to do so at all and (if so)
2. how you must design the access road.

Federal highways (e.g. B 105, B 96) are used for long-distance traffic. This should run as smoothly as possible. Turning from a road into an access road interferes with the flow of traffic. For an access road to a federal highway, you must therefore meet certain requirements. How strict these are depends in particular on the specific location of the access road.

Where access roads and buildings already exist on the federal highway, further access roads are regularly permitted ("common use"). However, you will also need a permit for work on the road there. This specifies how you must design the access road.

In all other cases, you must carefully check whether you are allowed to create or change the access road at all ("special use"). A separate permit is also required to change the traffic taking place on the driveway.

If you want to construct or modify a structural facility over the access road, the structural facility will be considered as part of the approval process for the access road. In this case, you may need two permits - one for the construction period (building site) and one for the permanent development.

Once it is determined that you are allowed to construct (or modify) your driveway at all, you will be told how you must design your driveway.

Your access road must not impair the function of the road. It must therefore meet special technical requirements (e.g. paving, reinforcement of existing facilities, specific location, culvert). This is the only way you can be sure that all components of the road (such as road edge, drainage systems, trees, sidewalks and bike paths, etc.) will remain functional.

You can find out which documents are required in your case on the application form. To prove the information in the application or for detailed information, you can submit the following documents, for example: Site plan, detailed plan, cadastral excerpt, documents on the building structure (general site plan, building permit, exemption or cover sheet of the building permit).

If it has to be checked exactly whether you are allowed to create or change the access road at all ("special use"), the access road can regularly only be approved under the following conditions:

• There is no other sufficient way to reach the property.
• A refusal would be unreasonably hard on the applicant.
• The access is compatible with public interests (e.g. safety or ease of traffic, expansion intentions, road design).

An access road to a federal highway can be the subject of a wide variety of procedures. Depending on the respective procedure and the associated responsibility, you will either receive a decision from the responsible road construction office or the road construction office will comment on the project vis-à-vis another responsible authority. In any case, however, the road construction office will check whether and, if so, under what conditions the access road and, if applicable, the facility accessed via the access road are permissible from the point of view of road law.
