The certificate of separate ownership is one of the prerequisites for being able to divide a property and the building on it into condominiums.
With the certificate of separate ownership, the competent authority certifies which rooms of a flat, separate cellars or garages form self-contained units of the residential building and are therefore eligible for separate ownership.
You need a certificate of separate ownership if you intend to
- to sell one or more flats in your apartment block individually or
- transfer a flat in your apartment block to your child.
- Site plan
- Building drawing (floor plans, views, sections) in duplicate at a scale of 1 : 100
For existing buildings, this must be an as-built drawing. All individual rooms belonging to a dwelling must be labelled with the same number in the floor plans.
Have a partition plan drawn up by an architect.
Submit the plan to the relevant authority and apply for a certificate of completion at the same time.
In the event of non-granting, a general action for performance before the competent administrative court for the issue of the Certificate of completion must be filed.
