If you wish to carry out pest control on a commercial basis, you must notify the competent authority.

Anyone who intends to carry out pest control on a commercial basis or independently as part of other commercial undertakings for a third party or not only occasionally and to a small extent in their own business in which food is produced, treated or placed on the market, or in a facility specified in Section 36 of the Infection Protection Act, or intends to resume this activity after an interruption of more than one year and intends to use very toxic, toxic and harmful substances and preparations, as well as preparations in which the aforementioned substances or preparations are released, must notify the competent authority at least 6 weeks before commencing the activity.

For this purpose, you must provide evidence of sufficient personnel resources. This is the case if suitable competent persons are employed. Competent persons are those who

• has passed the examination to become a pest controller or
• has passed the examination for the recognized qualification "Certified Pest Controller" or
• has passed the examination to become an assistant or master pest controller under the law no longer in force in the old federal states or under the law of the former GDR, or
• has demonstrably acquired comparable expertise in a Member State of the European Communities and
• undergoes regular further training.

Anyone who has passed an examination or successfully completed training that has been recognized by the competent authority as equivalent to the aforementioned examinations is also deemed to be competent. If the intended pest control is limited to certain areas of application, anyone who has passed an examination or successfully completed training that has been recognized by the competent authority as suitable for these activities shall also be considered competent.

The notification must contain the following information in particular:

• proof that the company's personnel, premises and safety equipment are sufficiently suitable for this work,

• the number of employees handling the pesticides,

• • Designations,
  • Properties,
  • mechanisms of action,
  • application methods and
  • decontamination procedures

of the pesticides intended for pest control,

• the areas of the intended pest control and the target organisms against which the pest control is to be carried out, and

• the result of the prescribed substitution test.

Notification at least six weeks before commencing work

As this is an area that is only regulated by national law, proof of comparable expertise from another member state of the European Community requires an equivalence check of the expertise, which also includes knowledge of the relevant national legal regulations.

For pest control of vertebrates, a certificate of competence in accordance with the Animal Welfare Act on the knowledge and skills required to kill vertebrates is also required.
