Building Code (BauGB)

During the preparation of the redevelopment (implementation of the preparatory study in accordance with §141 BauGB) and the implementation of the redevelopment (drafting of the redevelopment statutes, implementation of individual measures), information is provided on rights and obligations and there is the opportunity to comment on specified procedural steps for planning.

The aim of participation is to

• identify the interests of those affected by the redevelopment,
• to discuss the intended municipal plans and measures with them and
• to encourage those affected by the redevelopment to participate in the redevelopment.

The implementation of a redevelopment measure is a long-term process. The participation of those affected by the redevelopment is continuous. The participation of those affected is required by law during the preparation of the redevelopment as part of the preparatory investigation and when drawing up the redevelopment statutes.

Model standard procedure for carrying out the preparatory study:

1. Formal decision to draw up the preparatory study and define the study area
2. Implementation of the investigation
3. Discussion of the redevelopment objectives and measures with the affected parties and public agencies (TÖB)
4. Completion of the redevelopment when all necessary assessment bases are available

Model standard procedure for drawing up the redevelopment statutes:

1. Decision to draw up
2. Preparation of the bylaws
3. Involvement of the affected authorities and other public interest bodies or formal involvement of the authorities and other public interest bodies
4. Participation of the affected public or public display
5. Examination of the comments
6. Weighing up, resolution
7. Publication
