If a child is born during a voyage on a seagoing vessel that is entitled to fly the federal flag, there is an obligation to report the birth.
Each parent with custody is obliged to report the birth orally to the skipper without delay. If the parents are unable to do so, any other person who was present at the birth or knows about it is also obliged to report the birth. The skipper shall take a record of this and send it to Registry Office I in Berlin, which shall then certify the birth.
If the sea-going vessel on which the birth took place did not fly the German flag, the birth can be subsequently certified in a German birth register on application. In addition to the person to be registered, their parents, spouse or partner and their children are also entitled to apply.
If your child was born on a sea-going vessel sailing under a foreign flag and is to acquire German citizenship from you as German parents or a German mother or father, you must apply for subsequent certification within one year of the birth.
The registry office responsible for certifying the birth of a German child on a foreign-flagged seagoing vessel is the registry office in whose jurisdiction this person has or last had their place of residence or habitual abode in Germany. If this does not result in jurisdiction, the registry office in whose jurisdiction the applicant has or last had his or her domicile or habitual residence in Germany shall certify the birth. If there is no jurisdiction, the registry office I in Berlin will notarize the birth.
The following documents are required:
- foreign birth certificate of the child with translation into German, which has been carried out and certified by an officially recognized translator and, if necessary, legalization or apostille (an international birth certificate may be sufficient)
- for parents who are married to each other:
- Birth certificates of the parents
- Marriage certificate or a notarized printout from the marriage register
- for parents who are not married to each other:
- Birth certificate of the mother
- if paternity has already been recognized:
- Declaration of acknowledgment of paternity and the mother's declaration of consent
- Birth certificate of the father
- if applicable, the declaration of custody
- valid identity card, passport or a recognized passport replacement document of the parents
A marriage certificate and proof of dissolution of marriage must also be submitted if the marriage has since been dissolved or the husband has died within 300 days prior to the birth of the child.
If necessary, the registry office may request the submission of further documents, if necessary with translation, legalization or apostille.
The following requirements must be met:
- Birth on a seagoing vessel
