The Homeworking Act (HAG) protects those who work in their own home or in a place of business of their own choosing on behalf of tradespeople or intermediate foremen.
This is intended to prevent discrimination against these poorly visible workplaces.
The protective provisions of the Home Work Act are mandatory. They cannot be excluded by contract, nor can individual homeworkers subsequently waive them.
The provisions of the Home Work Act must be observed and complied with when assigning and performing home work. Remuneration is based on binding provisions that have the character of a collective agreement.
Anyone wishing to employ people to work from home for the first time must notify the competent authority. Notification is also required if homeworking is to be carried out irregularly or only to a limited extent.
The notification can be made informally.
The type and scope of the home office work to be assigned, the names and homes of the persons who are to receive home office work must be stated.
The Darmstadt Regional Council, Department VI Occupational Health and Safety, is responsible for the whole of Hesse.
