Courts of lay assessors shall be established at the district courts to hear and decide criminal cases within the jurisdiction of the district courts.
For the hearings and decisions of criminal cases that fall under the jurisdiction of the district courts, courts of lay assessors are formed at the district courts. The 5-year term of office of the currently appointed lay assessors ends on December 31, 2023. For this reason, lay assessors and juvenile lay assessors will be newly elected throughout Germany in 2023 for the period from January 1, 2024 to December 31, 2028.
Under the Juvenile Courts Act, juvenile misdemeanors are decided by the juvenile courts at the district court. The juvenile courts are the criminal judge as juvenile judge, the juvenile court of lay assessors and the juvenile chamber. The juvenile court consists of the presiding juvenile judge and two juvenile jurors, the juvenile chamber consists of three judges and two juvenile jurors.
During the main hearing, the lay assessors shall exercise the office of judge to the same extent and with the same voting rights as the full-time judges at the Local Court. The honorary judges are part of the state power emanating from the people (Article 20(2) of the Basic Law) and thus give special significance to the judgments "in the name of the people".
For each main hearing, 2 persons who are educationally qualified and experienced in youth education shall be called upon to serve as juvenile jurors. The requirements need not be professionally acquired. Also experience by the education of children or by honorary commitment is recognized for it.
Interested persons can apply if they
- have German citizenship
- are at least 25 years old and younger than 70 years old at the beginning of the term of office
- have their first residence in the city of Bremerhaven and
- are of good moral character
