Do you or one of your relatives need in-patient care or nursing because you are no longer able to look after yourself at home alone? Do you need help with everyday tasks such as personal hygiene, getting dressed or eating because of illness or disability and is a stay in a home unavoidable?
People in need of care, who are insured for health or nursing care, receive financial benefits for nursing care and household care from their nursing care insurance fund (Social Security Code XI). If someone is not insured for nursing care or if the benefits of the nursing care insurance are not sufficient, benefits of assistance for nursing care according to the Social Code XII come into consideration.
Entitled to benefits according to the Social Security Code XII are persons who are in need of care in a nursing home and for whom the nursing care insurance fund does not pay or does not pay sufficiently.
Example: There is a need for a home, the benefits of the social long-term care insurance are not sufficient and a personal contribution remains. Then further benefits are possible according to SGB XII.
The benefits according to SGB XII depend on the amount of income and assets.
In in-patient assistance for nursing care, in addition to the use of one's own income and assets, parental maintenance is used. Children who have reached the age of majority are basically obliged to pay maintenance if they are financially able to do so.
Statements on the use of income and assets, as well as on the calculation of parental maintenance are individually designed and therefore require advice.
Benefits of assistance for care according to the Social Code XII are subordinate to similar benefits under other legal provisions (e.g. benefits of social care insurance according to Social Code XI). For this reason, benefits under the Social Code XI are to be claimed as a priority claim to benefits before applying for benefits of assistance for long-term care under the Social Code XII.
If a need for assistance in care is to be assumed and if this need for care is not sufficiently financed by the benefits of the social care insurance (Social Security Code XI), assistance in care according to Social Security Code XII is applied for at the Bremerhaven Social Office.
