Do you or one of your relatives need outpatient care or nursing because you can no longer take care of yourself at home alone? Do you need help with everyday tasks such as personal hygiene, dressing or eating because of illness or disability?
People in need of care, who are insured for health or nursing care, receive financial benefits for nursing care and household services from their nursing care insurance (Social Security Code XI). If someone is not insured for nursing care or if the benefits of the nursing care insurance are not sufficient, benefits of assistance for nursing care according to the Social Code XII come into consideration.
The need for long-term care due to illness or disability includes not only everyday tasks such as personal hygiene, dressing or eating, but also domestic care.
One of the possibilities of benefits in Social Code Book XII is to "top up" an insufficient benefit from the social long-term care insurance. Example:
- There is a need for long-term care in a degree of care determined by the long-term care insurance fund, the necessary care by an outpatient care service is not sufficiently financed by the benefits of social long-term care.
A further entitlement to benefits according to Social Security Code XII exists for persons who
- are not covered by nursing care insurance,
- are not permanently in need of care (who are expected to need care for less than six months)
- have a lower need for care than is possible under social long-term care insurance (who do not require significant care)
and are therefore not entitled to benefits according to SGB XI.
The benefits according to SGB XII depend on the amount of income and assets.
Statements on the use of income and assets are individually designed and therefore require advice.
Benefits of assistance for nursing care according to Social Code XII are subordinate to similar benefits under other legal provisions (e.g. benefits of social nursing care insurance according to Social Code XI). For this reason, benefits under the Social Code XI are to be claimed as a priority claim to benefits before applying for benefits of assistance for long-term care under the Social Code XII.
If a need for assistance in care is to be assumed and if this need for care is not sufficiently financed by the benefits of the social care insurance (Social Security Code XI), an application for assistance in care (Social Security Code XII) is submitted to the Bremerhaven Social Office.
The need for outpatient assistance for care according to the Social Security Code XII is absolutely identical with the findings of the Medical Service of the Health Insurance (MDK). The social welfare agency must always determine and ascertain the necessary nursing requirements itself.
