If you have questions regarding the right of access or if a joint solution needs to be found with the other parent, you can seek advice from the Youth Welfare Office. If no agreement can be reached, it is possible to resolve the matter with the help of the family court.
If problems arise in connection with the exercise of the right of access, the parents concerned can first seek advice from the "Young People" department. The aim of the office is to mediate between the parties and to work towards compliance with an agreement that has been reached.
The "Young People" department passes the case on to the "Assistance, Maintenance for Minors" (BUM) department if children of unmarried parents are involved and no agreement can be reached. In this case, an application can be filed with the family court to regulate the right of access. There, another attempt is made to reach a joint solution.
If an agreement cannot be reached before the family court, it will make a decision on contact. This decision can also be enforced by means of coercion.
In addition, a special court mediation procedure on contact may be invoked. The court can summon the parents to a mediation hearing if one parent is thwarting or making it difficult to carry out a court order on contact. In these proceedings, the possibility of enforcement of the right of access is pointed out. If even the child's welfare is endangered, the care of the causing parent can be restricted or withdrawn.
The child's newly introduced right of contact is intended to send a signal to the parent who obstructs or prevents the child's contact with the other parent. It should become clear that this is not being done in the child's best interests.
