If you have a significant condition due to an illness, an accident or from birth that restricts your participation in life in the community, you can have these restrictions officially recognized as a disability. The disability must not be temporary, but must last longer than six months.

Before a severely disabled person's pass can be issued, the degree of disability must be determined. A degree of disability of 50 or higher must be determined in order to obtain a severely disabled person's pass.

The assessment determines the overall impact of one or more disabilities.

In particular, the degree of disability and other health features (characteristics) are then entered on the severely disabled person's pass.

The ID card with the respective characteristic (mark) is a prerequisite for claiming compensation for disadvantages, such as free travel on local public transport.

Erforderliche Unterlagen

Foreign jurisdiction of the AVIB

The AVIB is responsible for the following non-European countries for applications in the severe disability procedure in accordance with the German Social Code Book IX (SGB IX):

Latin America/South America; Canada, Caribbean, USA

In which cases does the AVIB become active?

According to Section 2 of Book IX of the German Social Code, people are severely disabled if they have a degree of disability of at least 50 and are legally resident, ordinarily resident or employed within the area of application of this Code.

According to the intention of the legislator, SGB IX should therefore only apply to people in the Federal Republic of Germany.

There are two exceptions to this rule:

  1. You are liable to pay tax in the Federal Republic and require proof to claim a so-called lump sum for severely disabled persons under income tax law
  2. claiming an early retirement pension for severely disabled persons from the statutory pension insurance scheme - but only for nationals of a member state of the European Union or a contracting state of the European Economic Area

In this case, a special interest in a determination would have to be substantiated.

If the check then reveals that a severe disability exists, a certificate would be issued as proof for submission to the tax office or pension insurance company.

A severely disabled person's pass cannot be issued.

Verfahrensablauf

After examining the application, the competent body issues a notice of assessment in which

  • the individual disabilities
  • the degree of disability and
  • the other health characteristics (markings)

are specified.

This notice is also issued if the degree of severe disability determined is less than 50.

If the responsible office has determined a degree of severe disability of 50 or more, you are entitled to a severely disabled person's pass

Bearbeitungsdauer

We will make every effort to process your application as quickly as possible. However, we would like to inform you that despite all efforts, there is currently unfortunately a longer processing time. The reason for this is that the medical service at the Office for Supply and Integration Bremen - AVIB is not sufficiently staffed due to the shortage of doctors. We are currently working hard to find medical staff and also to optimize our processes. Due to the complexity of the matter, however, this is not an easy undertaking. However, it is our declared goal to achieve shorter processing times as quickly as possible. It is the citizens' right to expect that decisions on benefits provided for by law are made quickly. Please bear in mind that, at present, every application must be submitted to the AVIB's medical service after all the necessary documents have been received for the assessment of the illnesses in question. The AVIB's medical service is thus responsible for all medical opinions issued by the Office, including the disability determination procedure, and is unfortunately indispensable for the procedure. Due to the lack of personnel in the AVIB's medical service, a processing time of approx. 10 months is currently to be expected. We would like to emphasize again that we regret this very much and that this does not correspond to our understanding of a citizen-oriented administration. Unfortunately, we have to ask for your understanding and patience for the long waiting time. Documents from citizens who are ill with cancer or who are employed are usually evaluated by the medical service within 3 weeks after complete receipt. Exception to this is the working citizen:in, where there is already a recognition of at least 50. Here, the protection against dismissal is already in place.

In the case of a severely disabled person, it is often the case that several health disorders coincide (multiple disabilities).

The health disorders can exist independently of each other, but they can also overlap and reinforce each other. The mutual relationships between the individual health disorders are taken into account when determining the degree of disability.

If the degree of disability is 30 or 40, there is the possibility of equalization at the Employment Agency. However, this only applies if you cannot obtain or keep a suitable job without equalization. You can obtain further information on equalization from your local employment agency.

The severely disabled person's pass of deceased persons must be returned. A copy of the death certificate must be attached to the ID card.

Persons with severe disabilities are entitled to have an accompanying person with them when using public transport if they are regularly dependent on help from others to avoid danger to themselves or others as a result of their disability. The individual case must always be examined.
