Anyone wishing to buy or sell certain prohibited paints and varnishes for restoration or maintenance purposes requires a permit.

Certain paints and varnishes may not be placed on the market if they contain a level of volatile organic compounds that exceeds the specified limit. This mostly applies to paints and varnishes used to coat, restore and maintain buildings and vintage vehicles.
If you wish to place such paints and varnishes on the market as a buyer or seller, you must apply for a permit from the competent authority.

The application must contain the following information:

• Information on the required restoration and maintenance work
• Information about the ready-to-use product to be bought or sold for these purposes and the product category
• Product safety data sheet
• Indication of the quantity of product required for the restoration or maintenance work
• Proof that a low-solvent product is not suitable for the purposes
• Proof that the building or vintage vehicle is classified as being of particular historical and cultural value

The application can only be submitted if the paints and varnishes and vehicle refinishing products in question are used for the following purposes:

• for the restoration and maintenance of buildings, their components and decorative building elements
• for the restoration and maintenance of vintage vehicles that are classified as being of particular historical and cultural value.

An administrative fee must be paid for the granting of a permit, which is calculated according to the time spent in accordance with Section 2 of the fee schedule for the areas of occupational health and safety as well as plant and product safety.

• Submit an informal application to the responsible authority and attach all required documents.
• If the required documents or information for processing are incomplete, you will be contacted by the processing department.
• If the necessary requirements are met, you will receive the permit.
• The notice will be sent to you by post.
• The fee notice will usually be sent to you later.

The processing time is a maximum of three months. It begins when the complete documents are received. The deadline can be extended once by the authorities with justification if there is a justified need for this. For this reason, it is advisable to submit the application in good time before the planned restoration or maintenance work is due to be carried out.

The permit must be applied for before starting the activity. The activity may only be started once the permit has been granted.

The building or vintage vehicle for which the paints or varnishes are intended must be classified as being of particular historical and cultural value.

An objection to the decision can be lodged with the relevant authority or department within one month of notification. The unsuccessful objection procedure is subject to a fee.
