If you want to open a private hospital, private maternity hospital or private psychiatric clinic, you must apply for a license.
As an entrepreneur who wants to operate a private hospital, a private maternity hospital or a private psychiatric clinic, you need a license. To obtain a license for your private clinic, you must meet personal, structural and operational-organizational requirements.
The licence will not be granted to you in the following cases:
- If there are facts that suggest that you are unreliable for the management or administration of an institution or clinic.
- If there are facts that you cannot guarantee the medical or nursing care of the patients.
- If the descriptions and plans you have submitted for structural and other technical facilities do not comply with health and safety requirements.
- If the institution or clinic is to be located in only part of a building that is also occupied by other people and its operation could cause significant disadvantages or dangers for the people living in the building.
- If the institution or clinic is intended to accommodate persons with infectious diseases or persons with mental disorders and its location may cause significant disadvantages or dangers for people in the vicinity.
For the last two points, the local police and municipal authorities must be consulted.

- Appointment of the responsible medical director including certified copies of the license to practice medicine and the specialist certificate
- Named staff overview with information on the professional qualifications of the doctors (copy of the license to practice medicine) and the staff who are responsible for ensuring the nursing and therapeutic care of the patients.

- List of rooms with room number and number of beds

- for new buildings/conversions: building permit
- if applicable, rental, lease or purchase agreement
- if necessary, approval for the misappropriation of living space
More information:
- Declaration on the medical and nursing care "around the clock", in particular the on-call service
- Specific information on emergency equipment and the organization of emergency care at the clinic
- Information on patient catering, if necessary naming the caterer
- Information on who the medicines are obtained from, who disposes of the clinical waste, who does the laundry and who cleans the premises

After the exam, you will receive the result in writing
The license is granted for an unlimited period of time, provided that no changes are made to the clinic premises or similar.
According to the law, only private hospitals that are operated commercially, i.e. with the intention of making a profit, are covered. Day clinics, practice clinics or other facilities in which medical services are provided exclusively on an outpatient basis are not included.

- An institution or clinic is intended for the admission of persons with infectious diseases or persons with mental disorders and the location may cause significant disadvantages or dangers for people in the neighbourhood
