Hamburg Housing Protection Act - HmbWoSchG

With this online service you can get a housing protection number and edit the occupancy calendar.

If you would like to let other people use the living space you use yourself for a short time, for example as a holiday apartment or rent it out to fitters, you need a housing protection number.
Registration is required in any case, even if use is not subject to approval.
You also need a registration number if you leave living space for another purpose or leave rooms that are not living space and would like to place offers or advertising for this, for example in a holiday home portal on the Internet, in a magazine or in another medium in which mainly short-term letting advertised by apartments.

Create service account
If you already have a so-called service account from the city of Hamburg, you can skip this step.
You can create your service account at serviceportal.hamburg.de. To do this, click on “Register”. On the following page you can choose what type of service account you want to create. You can use the service with the simple service account as well as with the service account plus or the service account business.
Enter the data requested there and read and accept the data protection regulations. You will then receive an email with a link that you must click to activate your service account.

You can then register at the above Internet address. Click Start Here. Read and confirm the data protection declaration that is then displayed. Then click on "Issue new housing protection number".
On the following form pages, your name and e-mail address have already been filled in, they were taken from your service account. Please complete the other data requested there about yourself. Then select the type of room and what use it is intended for. Depending on your selection, you will then be asked for the address of your main residence or your contact address. Please fill out the appropriate fields and click “Next”.
Depending on your selection on the previous page, you will then be asked for further information that is necessary for registration. This involves, for example, the location of the property and more detailed information on the scope of the intended use. Fill in the appropriate fields and click “Next” each time.
You will now see an overview where you can check whether the data you have entered is correct. Some information about the housing protection number is also displayed there. If all data is correct, please click on "Send data". If the intended use takes place in your main residence, an automated check will be carried out to ensure that your details match the population register.

Allocation of the housing protection number
If this is the case and the intended use does not require a permit, the housing protection number will be displayed to you immediately. You can use the number immediately.
If no number could be displayed because an error occurred, please contact your responsible district office.
If the intended use requires a permit, your responsible district office will contact you. Please be patient until then.

Tax Obligations
The request and notification of a housing protection number does not exempt you from the notification and registration obligations of the culture and tourism tax for the taxation of paid private overnight stays in accommodation facilities. Further information, leaflets and the necessary declaration forms can be found on the website of the Hamburg tax authority (see link "Responsibilities for culture and tourism tax"). The other tax obligations (e.g. income tax and possibly sales tax) are also not affected by this. If you have any questions, please contact the tax office responsible for your place of residence.

The Hamburg Housing Protection Act provides, among other things:

• a registration obligation for providers of holiday apartments in living space,
• a registration obligation for providers of rooms on holiday apartment platforms and comparable media,
• a shortening of the exception to the ban on misappropriation, i.e. the ban on using an apartment for anything other than living, to eight weeks per calendar year,
• the introduction of an obligation to report each individual release to the competent authority after ten days at the latest,
• the introduction of an obligation for service providers and other media to only allow offers with a registration number (housing protection number),
• the expansion of the catalog of fines and the increase in the maximum fine to 500,000 euros,
• the forwarding of the registration data to the tax authorities.

Licensing of one's own apartment for no more than eight weeks in a calendar year does not require approval. This online service is available for registration. The data entered during registration is automatically checked against the population register. The registration number is usually assigned immediately after the data has been entered.
