Family members of Germans do not get a residence card under the Freedom of Movement Act, but can receive a residence permit under the Residence Act if they are not an EU or EEA citizen themselves.

- Third-country nationals and family members of EU and EEA citizens can, if the conditions are met, move freely within the EU with their caregiver, enter any EU or EEA member state and reside there.
- Family members are spouses, life partners and relatives in the direct descendants (e.g. children) and ascendants (e.g. parents and grandparents) under the age of 21 or who are granted maintenance
- If the reference person is studying in Germany, only spouses and life partners as well as children are entitled to join them.
- A visa is required for entry, unless entry can be made visa-free.
- There are no requirements for staying in Germany for three months; only a passport or passport replacement is required and someone accompanying the person of reference must be identifiable.
- For stays of more than three months a residence card is required.
- The residence card is issued ex officio within six months. No application is required; only the information required for the residence card to be issued must be provided; this can be done when registering with the registration office or directly with the immigration office.
- The immigration authorities check the freedom of movement requirements and can request proof of this; no proof of language skills is required.
- Until the decision is made, your stay in Germany is considered legal.
- The residence card is usually issued for five years, unless a shorter period arises. After five years, a permanent residence card can be applied for
- With the residence card, any gainful activity is permitted.
- For persons under 18 years of age, the consent of the legal guardians is required to stay in Germany.
