If you want to open a new pharmacy or take over one, you will need an operating license. You can apply for this from the responsible authority.
- Written application stating whether and, if so, where you operate additional pharmacies in Germany, a member state of the European Union or another contracting state to the Agreement on the European Economic Area
- German license to practice as a pharmacist
- Declaration under oath that you have not entered into any agreements contrary to the Pharmacy Act
- Purchase or lease agreement of the pharmacy
- other contracts related to the establishment or operation of the pharmacy
- Proof that you have suitable premises and facilities
- You are fully capable of doing business.
- You have a German license to practice as a pharmacist.
- You have the reliability required to run a pharmacy.
- They have suitable operating rooms and facilities.
- You are medically fit to run the pharmacy properly.
- You submit your written application for a pharmacy operating license and all necessary documents to the responsible authority.
- The responsible authority will examine your application.
- The responsible authority will check your documents and, if necessary, request further documents from you.
- If you are opening a new pharmacy, you will be given an appointment to inspect the operational pharmacy before opening.

Submit the application at least 2 months before the planned opening of the pharmacy. All required documents should be available at least 2 weeks before the pharmacy opens.
With the amendment of the Pharmacy Act of August 12, 2002 and after its announcement in the Federal Law Gazette on August 27, 2002, Section 12a ApoG came into force on August 28, 2003. According to this, the holder of a permit to operate a public pharmacy is obliged to conclude a written contract with the operator of the home to supply residents of homes within the meaning of Section 1 of the Homes Act with medicines and medical products that require a prescription. This must be approved by the responsible authority.
