According to the custom of international law, a divorce is initially only effective in the state in which it was carried out. If the marriage is also to be effectively resolved for the German legal area, the formal recognition of the foreign divorce is required.
- One of the spouses of the divorced marriage has his habitual residence in Hamburg or Hamburg at the time of the application for recognition
- Neither of the spouses of the divorced marriage has his habitual residence in Germany, but a new marriage is to be concluded in Hamburg
From September 1st, 2022, the Hanseatic Higher Regional Court will be responsible for the recognition of foreign divorces.
All procedures that have not yet been completed by the authority for justice and consumer protection will also be continued there.
