If you have a permit in accordance with § 7 or § 27 of the SprengG, you are obliged to notify the trade supervisory office of the intended fireworks in good time.
Pyrotechnic articles are divided into different categories. The obligation to notify relates to the setting off of pyrotechnic articles in categories F2 (January 2 to December 30) and F3, F4, P1, P2, T1 and T2 (all year round).
This is based on § 23 Para. 3 of the 1st SprengG.
The notification must contain the contact details of the person responsible for setting off the fireworks as well as the issuing authority, the date of issue and the number of the license (permit pursuant to § 7 or § 27 SprengG, certificate of competence pursuant to § 20 SprengG).
In addition, the following information on the intended fireworks must be included in the notification:
- Type of fireworks
- Place where the fireworks are to be set off
- Scope of the fireworks
- Start and end of the fireworks display
- Safety measures
- Site plan indicating the safety distances
If you do not have a permit in accordance with the Explosives Act (SprengG), you require a permit from the local municipality if you wish to set off category F2 fireworks in the period from January 2 to December 30.
- Permit according to § 7 or § 27 Explosives Act
- certificate of competence according to § 20 Explosives Act
- current site plan (site plan of the surroundings and marking of the burning place of the fireworks)
Map of the surrounding area and marking of the fireworks burning site
- If applicable, already existing approvals of involved authorities
You must either have an explosives permit in accordance with § 7 or § 27 of the Explosives Act (SprengG) or, as the holder of a certificate of competence in accordance with § 20 SprengG, act at least on behalf of a person who is in possession of an explosives permit in accordance with § 7 SprengG (so-called person responsible for setting off the fireworks).
The use of the online procedure for preparing the notification is free of charge.
If the deadline is shortened: in the standard case EUR 150.00 plus expenses (deviations from this are possible in the case of increased expenditure)
The notification with the required documents must be submitted to the trade supervisory office responsible for the place where the fireworks are to be set off.
The intended setting off of fireworks only needs to be reported; a permit is not issued by the trade supervisory office.
The notification must be received by the Trade Supervisory Office at least 2 weeks before the date of the fireworks display. If the fireworks are to be set off in the immediate vicinity of railroad installations or airports, the notification period is 4 weeks.
Exceptions to the notification period are possible under certain conditions. You can apply to the Trade Supervisory Office for an exception to the notification period (shortened deadline). This application must contain a comprehensible justification and be received by the office as early as possible so that the office has sufficient time to process the application.
