A boundary determination is the discovery and verification of existing boundary signs, the marking of previously unmarked boundaries or the restoration of lost boundary signs. You can apply for a boundary determination.
The obligation to mark boundaries has only existed since 1900, which is the reason why there are still many boundaries in Bavaria that are neither marked nor precisely known to the owners. Legal certainty is created by the remeasurement and marking of these boundaries by the State Offices for Digitization, Broadband and Surveying.
Furthermore, boundary markers are lost or buried for various reasons (construction work, field work, etc.).
Boundary demarcation therefore consists of the marking of previously unmarked boundaries and the uncovering of boundary markers (with verification) or the restoration of lost boundary markers.
If you cannot find the boundary stones on your property boundary, you can apply for a boundary determination there.
The fee is based on the number of old and new boundary points established in the locality.
The fees for the boundary points are
- for the 1st boundary point: EUR 260
- for the 2nd to 30th boundary point: EUR 85 each
- for the 31st to 100th boundary point: EUR 70 each
- for all other boundary points: EUR 60 each
In addition, the sum of the boundary point fees is multiplied by a value factor that depends on the land value (market value) of the parcels of land in question:
- up to EUR 5 - value factor 0.8
- over 5 to 25 EUR - value factor 1.0
- over 25 to 50 EUR - value factor 1.3
- over 50 to 200 EUR - value factor 1.7
- over 200 to 500 EUR - value factor 2.0
- over 500 to 2500 EUR - value factor 2.5
- over 2500 to 4000 EUR - value factor 3.5
- over 4000 EUR - value factor 4.0
The application can also be submitted urgently for a surcharge of 20%.
In addition, there may be fees for the field surveyors to carry out the marking out.
