Land charges and other mortgages can be deleted at the request of the property owner or the mortgagee.
If the creditor of a land charge or other mortgage approves the deletion from the land register, the owner can apply for the deletion of the right at the land registry.
The following documents must be submitted to the land registry for the deletion of a mortgage:
- The consent of all owners entered in the land register to the deletion of the mortgage in publicly notarized form.
- The creditor's consent to deletion in a publicly notarized form. In the case of savings banks and Landesbanken, the bank's seal is sufficient.
- In the case of rights by letter additionally:
- The original mortgage certificate or
- Exclusion order in copy with a note of legal force
At your request, a notary will obtain the necessary documents and monitor the execution of the deletion application.
The fees according to the schedule of costs of the German Court and Notary Costs Act (GNotKG) are based on the market value of the right to be extinguished.
