If you wish to work as a prostitute, you must attend a health consultation in accordance with Section 10 of the Prostitutes Protection Act (ProstSchG) at the public health department before registering for the first time.
§ Section 10 of the Act on the Protection of Persons Engaged in Prostitution (Prostitutes Protection Act - ProstSchG) provides for persons who work as prostitutes or want to take up such an activity to receive health advice from an authority responsible for the Public Health Service (ÖGD). In Bavaria, these are the health authorities at the respective district administrative authorities. The health counseling is adapted to the personal life situation of the person being counseled and is intended in particular to address issues such as
- the prevention of disease,
- the regulation of conception,
- pregnancy and
- the risks of alcohol and drug use
use.
Health counseling is confidential. The person receiving counseling is given the opportunity to disclose any existing predicament or emergency situation. Third parties can only be called in for the purpose of language mediation if all parties agree.
After the consultation, the competent authority (public health department) issues the person receiving the consultation with a certificate containing the following information:
- First and last name of the person receiving counseling,
- Date of birth of the person receiving counseling,
- issuing office of the ÖGD and
- Date of the health consultation.
The certificate of the health consultation
- can be issued to the alias at the request of the person receiving advice (this requires an existing alias certificate. The alias certificate is only issued in the registration procedure, for which a certificate in accordance with § 10 ProstSchG is required. Consequence: The health consultation certificate must always be issued in the real first and last name for the first consultation; the alias may then be considered for subsequent certificates),
- is valid throughout Germany,
- must be carried by the prostitute when carrying out the activity.
The health consultation certificate is a prerequisite for registering as a prostitute.

The prerequisite for receiving the certificate of health advice is participation in a corresponding consultation.
Health advice is provided by the ÖGD in the district administrative authorities (state and municipal health authorities).
The local health authority is responsible for the place where you intend to focus your activities as a prostitute, provided that prostitution is permitted there. In municipalities with fewer than 30,000 inhabitants and in some other larger municipalities, prostitution is completely prohibited by law. Therefore, only health authorities in whose district there is a municipality with at least 30,000 inhabitants in which prostitution is not completely prohibited by a local prohibition ordinance are responsible.
Individual health authorities may have separate consultation hours with separate appointments for health advice.
The health consultation must take place before the first registration of the activity and, in the case of
- prostitutes aged 21 and over at least every twelve months and
- prostitutes under the age of 21 at least every six months.

The certificate of the health consultation can be used for three months for the initial registration of the activity as a prostitute (Section 4 (3) sentence 1 ProstSchG).
