Purpose
The Free State of Bavaria has a considerable state interest in establishing nationwide provision of specialized outpatient palliative care (SAPV) services for the population in Bavaria, because more people should be able to live in their own homes until the end. The conclusion of SAPV contracts is progressing only hesitantly. One of the reasons for this is that SAPV teams are only able to carry out the necessary development work with a delay due to a lack of funds. Previous experience with start-up funding suggests that the funding enables SAPV teams to establish themselves quickly in their care area. The funding will therefore be continued.
Object
The Bavarian State Ministry of Health and Care grants subsidies (grants) for eligible expenses in the start-up phase of SAPV teams without legal obligation and within the scope of available funds The start-up phase comprises the foundation phase (phase between the prospect of a care contract and the conclusion of the contract) and the first months after the conclusion of the contract. The start-up phase of an SAPV team is not included in the scope of services of the care contract. The start-up phase begins at the earliest from the date of the written prospect of the supply contract by the Association of Health Insurance Associations in Bavaria (ARGE). The start-up phase ends no later than six months after conclusion of the contract. Funding is granted for a maximum period of six months during the start-up phase.
Recipients of funding
Recipients of funding are SAPV teams to which the consortium has offered the prospect of a care contract or with which the consortium has concluded a care contract. SAPV teams are teams that provide outpatient specialized palliative medical and palliative care services, including their coordination. SAPV teams must meet the requirements of Section 37b SGB V, the guidelines of the Federal Joint Committee on the prescription of specialized outpatient palliative care (announcement of the Federal Joint Committee dated 20.12.2007), the joint recommendations of the National Association of Statutory Health Insurance Funds in accordance with Section 132d (2) SGB V dated 23.06.2008 and the model contract of the ARGE in the currently valid version. SAPV teams that are exclusively dedicated to SAPV for children and adolescents can also receive grants in accordance with this funding information.
Eligible costs
Eligible costs are expenses that are necessarily incurred during the start-up phase of an SAPV team and are not reimbursed under the care contract with the ARGE. These are in particular
- Personnel expenses
- Material expenses (e.g. office equipment, office supplies, telephone costs)
- Rent for premises of the SAPV team during the start-up phase
- Public relations expenses (e.g. flyers, internet presence, travel expenses).
Type and amount
The Bavarian State Ministry of Health and Care grants a subsidy of a maximum of 15,000.00 euros per team for the establishment of SAPV teams during the start-up phase. The grant is awarded by way of project funding as shortfall financing. There is no legal entitlement to the funding. The grant recipient must bear at least 10% of the eligible expenditure themselves.
- Proof of sponsorship
The legal form of the SAPV team must be described precisely and proven by suitable documents (e.g. excerpts from the commercial register or register of associations).
- a detailed description of the measures applied for
The application must contain a detailed description of the measures requested and the period envisaged. The measures must be economic and appropriate. The necessity of the support must be presented.
- Inception of a supply contract / supply agreement
The written promise of a supply contract by the ARGE or the supply contract itself must be enclosed.
- Statement of total expenditure for the measures requested
The calculated total expenses must be presented in detail. Only expenses that are necessarily incurred in the start-up phase and that are not reimbursed by the ARGE supply contract may be claimed. Expenses that are incurred proportionately in the set-up phase may only be included proportionately.
- Financing of total expenditure
It must be shown how and by whom the total expenditure is financed (e.g. own funds [at least 10 %], loans, grants from third parties, donations, grant from the Bavarian State Ministry for Health and Care).
- Concept
The concept checked by the ARGE is to be enclosed.
- Form 'Facts relevant to the subsidy ... - Declaration'.

The prerequisite for the grant is the written prospect of a care contract by the Arbeitsgemeinschaft der Krankenkassenverbände in Bayern (ARGE) or the conclusion of a care contract. A prospect or conclusion of a contract takes place after the ARGE has examined the requirements for the SAPV team and the economic viability of the future operation of the SAPV team.
Measures that have already begun cannot be funded. SAPV teams must therefore declare that the measure has not yet begun and will not begin before the grant notice is issued.
Reference is made to the possibility of applying for approval of the early start of the measure.
The prerequisite for the grant from the Bavarian State Ministry of Health and Care (StMGP) is that the start-up phase of the SAPV team cannot be financed in any other way. This means that the grant is subsidiary to all other benefits (see Art. 23 of the Bavarian Budget Code - BayHO).
Submission of applications
Applications should be sent to the Bavarian State Ministry of Health and Care (Department 46).
Approval
The Bavarian State Ministry of Health and Care will issue a grant notification following a positive review of the application.
Disbursement
The grant is paid out upon written application. The "Application for disbursement" form must be used for the application for disbursement. The grant may only be requested to the extent that it is required within two months for payments due under the purpose of the grant and not before.
Furthermore, the grant may only be requested once the grant recipient's own and other funds have been used up.
The Bavarian State Ministry of Health and Care generally withholds a final installment from the grant, which is only paid out after the proof of use has been checked.
