You can notify the Bavarian Chamber of Civil Engineers (Bayerische Ingenieurekammer-Bau) of the commencement of work as a test expert for stability and apply for the issue of a certificate of fulfillment of the requirements as a test expert.

In Bavaria, only those who are recognized in this specialist area and this specialist field may use the title "Inspection expert for stability" in a specific specialist field.

Inspection experts for stability can be recognized in the fields of solid construction, metal construction and timber construction.

Inspection experts for stability check and certify the completeness and correctness of the stability certificates in their respective field of specialization on behalf of the building owner or other person responsible according to building regulations, insofar as this is provided for in Art. 62a Para. 2 BayBO. They monitor the proper execution of construction work with regard to the stability certificates certified by them (Art. 77 Para. 2 Sentence 1 No. 1 BayBO and § 13 Para. 5 PrüfVBau). They are independent within the scope of their duties.

Foreign inspection experts, i.e. those who are established in another member state of the European Union (or equivalent state) to perform this task, are authorized to work as inspection experts in Bavaria under certain conditions. They must give prior notification of the first-time provision of services or apply for a certificate of compliance with the material requirements.

• Notification of the first performance of the service:
  • Certificate of legal establishment in a member state of the EU (or equivalent state) for the performance of the activity
  • Proof of fulfilment of comparable requirements for the exercise of the activity in the state of establishment
• Request for certification:
  • Certificate of legal establishment in a member state of the EU (or equivalent state) for the performance of the activity
  • Proof of actual fulfilment of the recognition requirements

Persons who are established in another member state of the European Union (or equivalent state) to perform this task are authorized to work as an inspection expert in Bavaria if they

• have a comparable authorization with regard to their field of activity and had to meet comparable requirements with regard to the recognition requirements and proof of knowledge (1st alternative) or
• if the recognition authority has certified that they meet the requirements for recognition as an inspection expert with regard to the recognition requirements, proof of knowledge and scope of activity (2nd alternative).

A further requirement is that they have a good command of written and spoken German.

The notification or application is not required if a notification has already been made or a certificate has already been issued in another country of the Federal Republic of Germany.

• Confirmation of notification in the case of a comparable authorization in another Member State or a country treated as such with comparable requirements: EUR 40.00
• Prohibition to act in the case of a notification of a comparable authorization: 350.00 EUR
• Certification of the existence of the recognition requirements in the case of non-comparable authorization in another Member State or a country treated as such: EUR 385.00

The notification must be submitted in text form to the Bavarian Chamber of Civil Engineers before the service is provided for the first time.
