Natural and legal persons as well as companies without legal personality who wish to provide legal services in the field of debt collection, as pension consultants and as legal experts in a foreign law on a permanent basis (registered persons) require registration in accordance with the Legal Services Act (RDG). The application must be submitted to the Federal Office of Justice.
- Application for registration in accordance with the Legal Services Act with all information to be entered in the legal services register in accordance with Section 16 (2) sentence 1 no. 1 RDG
- a summary of the professional training course and the professional practice to date
- Documents proving theoretical and practical expertise (separate for each qualified person)
- a notification that a certificate of good conduct in accordance with Section 30 (5) BZRG has already been applied for for submission to an authority (separately for each qualified person)
- in the case of an application for registration for debt collection services, information in accordance with Section 150 (5) GewO
- a declaration as to whether insolvency proceedings are pending or whether an entry has been made in the debtor register (Section 882b ZPO) in the last three years prior to filing the application
The prerequisites for registration are personal suitability and reliability, theoretical and practical expertise in the areas in which the legal services are to be provided, as well as professional liability insurance with a minimum sum insured of EUR 250,000.00 for each insured event (Section 12 (1) RGD).
Theoretical and practical expertise must be proven to the Federal Office of Justice on the basis of documents (§ 13 Para. 1 No. 5 RDG, §§ 2, 3 RDV). The Federal Office of Justice provides information on the details.
Legal entities and companies without legal personality must appoint at least one natural person who meets all the requirements set out in Section 12 (1) Nos. 1 and 2 RDG (qualified person, Section 12 (4) RDG).
A fee of EUR 300.00 is charged for registration in accordance with the RDG (No. 1230 Annex (KV) to the JVKostG).
A fee of EUR 150.00 is charged for the registration of each additional qualified person (No. 1231 Annex (KV) to the JVKostG).
The Federal Office of Justice will decide on an application for registration under the Legal Services Act no later than three months after receipt of all required application documents. In individual cases, the processing period may be extended if necessary.
