Nichtstaatliche Hochschule; Beantragung der staatlichen Anerkennung

Educational institutions based in Bavaria can be officially recognized as universities by the Bavarian State Ministry of Science and the Arts upon application by the responsible body.

State recognition determines the name, location and sponsor of the higher education institution as well as the recognized degree programmes and the academic degrees to be awarded upon graduation.

State recognition entitles the university to conduct university examinations, award university degrees and issue certificates within the scope of recognition; these confer the same rights as university examinations, certificates and university degrees of the same degree programs at state universities.

State recognition can be granted if

• the financial circumstances of the institution give reason to expect that the necessary funds for the operation of the higher education institution and for an education equivalent to state higher education institutions will be provided on a permanent basis,
• a number of degree courses leading to a first professional qualification are planned; this does not apply if the establishment of a number of degree courses within a subject area is not suggested by the scientific development or the corresponding professional field of activity,
• only persons who meet the requirements for admission to a corresponding state higher education institution may take up the course of study,
• the teaching duties of the higher education institution are predominantly carried out by full-time teaching staff and the teaching staff fulfill the hiring requirements that are required for corresponding activities at state universities,
• the economic and legal position of the full-time teaching staff is secured,
• the members of the institution participate in the organization of studies in analogous application of the principles applicable to state universities and
• it is ensured that the institution fulfills its tasks within the framework of the state order guaranteed by the Basic Law and the Constitution of the Free State of Bavaria.

A fee is charged. The amount depends on the administrative costs associated with the recognition.
