Purpose

The purpose of the funding is to create additional places in all-day education and childcare facilities for children of primary school age in Bavaria in order to be able to provide a needs-based offer for this age group.

Object

The following are eligible for funding

  1. Eligible expenditure for investments (new construction, conversion, expansion, [energy-related] general and partial refurbishment in accordance with No. 2.1.3 FAZR as well as acquisition including conversion) and
  2. investments in equipment

for additional places in all-day education and childcare facilities for children of primary school age that are created from October 12, 2021 to December 31, 2027.

Eligible costs

The financial assistance is granted for additional investment measures by the municipalities/municipal associations or the municipal school expenditure providers of public schools and the providers of state-approved and state-recognized alternative schools as well as private, non-profit recognized or public providers of integration assistance and recognized providers of independent youth welfare services for the quantitative expansion of all-day education and care services for children of primary school age.

Type and amount

The funding is granted as a subsidy.
The type of funding is project funding.
The funding period covers the entire duration of the project.

The grant is provided as a non-repayable subsidy for project funding by way of fixed-amount financing.

In connection with and in addition to the basic funding under the Bavarian Financial Equalization Act (BayFAG), the Bavarian School Financing Act (BaySchFG) and the guidelines for investment funding for educational assistance facilities and assistance for disabled minors, a lump sum is granted for each additional childcare place created that fulfills the legal entitlement.

The amount of the per-place lump sum for eligible expenditure for investments (new construction, conversion, extension, refurbishment, acquisition) is: EUR 6,000 and for equipment investments as a rule EUR 1,500 and in special cases up to EUR 3,000 for each additional place created that fulfills the legal entitlement.

Voraussetzungen

Funding is provided for eligible expenditure for investments to create additional childcare places for children of primary school age in child and youth welfare services, integration assistance and under school supervision, which meet the legal entitlement to a full-day (i.e. 8 hours each weekday including lessons) education and childcare offer in accordance with Art. 1 of the All-Day Support Act (GaFöG), which will apply from August 1, 2026. Additional childcare places are those that are either newly created or places that are retained and would be lost without replacement without maintenance measures.

Eligible for funding are measures that are started from October 12, 2021 and completed by December 31, 2027.

The prerequisite for funding eligible expenditure for investments (new construction, conversion, extension, [energy-related] general and partial refurbishment in accordance with no. 2.1.3 FAZR and acquisition including conversion of a building in accordance with no. 2.1.2 FAZR) is that the construction investment is eligible for funding in principle in accordance with the BayFAG, the BaySchFG or the guidelines for investment funding for educational support facilities and assistance for disabled minors.

Eligible applicants are

  • the municipal school authorities of public schools,
  • the providers of state-approved and state-recognized alternative schools and
  • the local providers of public youth welfare services (rural districts and independent cities),
  • the towns and municipalities belonging to the district in the area of child day care and
  • private, non-profit and public providers of integration assistance as well as
  • recognized providers of independent youth welfare services.

If a measure is carried out by a non-profit or other provider (this does not include providers of state-approved and state-recognized alternative schools and private, non-profit and public providers of integration assistance as well as recognized providers of independent youth welfare) and the municipality contributes to the construction or acquisition costs with a grant, the municipality receives a subsidy.

Verfahrensablauf

For funding under these guidelines, an application must be submitted in accordance with template 1a of the VV to Art. 44 of the Bavarian Budgetary Regulations (BayHO) (see under "Forms"). The application must be submitted to the locally responsible district government. The application can and should generally be submitted in conjunction with the application for basic funding in accordance with BayFAG or BaySchFG. In addition to the application in accordance with template 1a of the VV to Art. 44 BayHO, further information must also be provided when submitting the application for funding (a supplementary sheet to the application is available for this purpose). Proof of use must be submitted to the locally responsible district government within six months of fulfillment of the purpose of the grant, but no later than six months after the end of the approval period using sample 4 of the VV to Art. 44 BayHO. Contact persons for specific questions regarding the respective funding are the locally responsible district governments as the granting authorities.

The application must be submitted by June 30, 2026 and applications for funding must be submitted to the locally responsible district government by the end of June 30, 2026 at the latest.

Hinweise

The legal entitlement to all-day care for children of primary school age will be introduced in stages and will first come into force in the 2026/2027 school year for children in Year 1. From the 2029/2030 school year, this will apply to all children of primary school age. The federal legal basis for the introduction of the legal entitlement can be found in the All-Day Support Act (GaFöG). It is therefore to be expected that the need for all-day childcare for children of primary school age will increase and that additional childcare places will have to be created. Federal funding will be made available for the corresponding spatial expansion of all-day facilities that meet the legal entitlement. The state funding program is generally based on the regular funding under the BayFAG, the BaySchFG and the guidelines for investment funding for educational assistance facilities and assistance for disabled minors.

Rechtsbehelf

The decision on the approval is an administrative act of the competent local government. If an applicant does not agree with the decision, they can lodge a complaint with the locally competent administrative court.
