The paid or commercial transportation of passengers by streetcar and motor vehicle is subject to the provisions of the Passenger Transportation Act (PBefG) and therefore requires a permit.
A regular service is a regular transport connection established between specific starting and end points on which passengers can board and alight at specific stops.
The government may grant exemptions from the regulations applicable to regular services in certain individual cases or in general for certain applicants.
The entrepreneur must prove that
- the safety and efficiency of the business is guaranteed (submission of balance sheets, asset overviews, etc.),
- he, the person appointed to manage the business and the transport manager are reliable (police clearance certificate, extract from the driving aptitude register, etc.),
- they are professionally qualified (certificate of professional competence from the Chamber of Industry and Commerce),
- he and the contractors commissioned by him to carry out transport services have their registered office or place of business within the meaning of commercial law in Germany.
In addition, the objective requirements for approval must be met (e.g. public transport interests, local transport planning requirements).
Costs (fees and expenses) shall be charged for official acts in accordance with this Act and the legal provisions based on this Act.
The Ordinance on the Operation of Motor Vehicle Operators in Passenger Transport (BOKraft) contains regulations that go beyond the Passenger Transport Act (PBefG) regarding
- the operation of road transport companies
- the conduct of drivers
- rules of conduct for passengers
- equipment and condition of vehicles
- the installation of stops
