You can have the monument status of your registered monument determined by administrative act.

The monuments protected under the Monument Protection Act are recorded in a list of monuments by the Brandenburg State Office for the Preservation of Monuments and the State Archaeological Museum.

The lists of monuments are kept separately according to ground monuments, architectural monuments and movable monuments.

Owners or other persons entitled to dispose of the monument can apply for the determination of the monument status by means of an administrative act.

Application

You are the owner or authorized to dispose of the monument or an authorized representative or authorized representative.

The monument must already be registered in the list of monuments of the state of Brandenburg.

An application for a declaratory judgment is only admissible if the monument was entered in the list of monuments of the state of Brandenburg on 24.05.2004 after the Brandenburg Monument Protection Act of 2004 came into force.

In the case of monuments that have been entered in the relevant lists or registers of monuments at an earlier date, such an application is not possible.

Note: No application for a declaratory judgment is possible as long as the monument status has not been clarified by the competent authority.
