Ordinance on the Use of Artificial Light and Electricity in Waters for Fisheries and Scientific Purposes (EFischV)

If you want to catch fish using an electric current, this is generally prohibited. You can apply for a special permit for certain purposes.

For certain purposes, the competent authority may allow you to catch fish using electricity upon request. These include: fisheries stocktaking and stock investigations, for conservation measures, for catching spawning fish, for research and teaching purposes and for fisheries water management. Furthermore, various requirements are placed on the electric fishing gear and its operators. Under certain circumstances, proof of catch must be provided.

• Operating license
  (Proof of successful participation in a recognized training course on electric fishing)
• Approval certificate, test certificate or type test report (confirmation that the electrical system to be used complies with the recognized rules of technology, in particular the standards of the Association of German Electrical Engineers)

You must state the purpose for fishing using electricity and submit the required documentation.

In addition, you may only fish using direct current or suitable pulsed direct current. You must use the electric fishing gear in accordance with the recognized rules of technology. You must comply with the duties of care arising from the operating instructions and the particular local circumstances.

Electric fishing is a form of fishing within the meaning of Section 17 (1) of the Fishing Act for the State of Brandenburg (BbgFischG) and generally requires a specialist permit in accordance with Section 17 (2) BbgFischG.

• You apply for permission (approval) to catch fish using electricity by completing and submitting the form. You must state the purpose and enclose the necessary documents.
• The competent authority will check your application for completeness and whether the technical requirements for an exemption permit are met.
• Once the examination has been completed, you will be notified of the rejection or approval in a decision. This decision may be subject to a fee.

If electrofishing is used for fishery surveys, stock investigations or for research and teaching purposes, a catch record must be kept in accordance with a specified model.

It should be noted that further permits/approvals may be required under public and private law, which are generally subject to a fee.

Electric fishing is a form of fishing within the meaning of § 17 Para. 1 BbgFischG and generally requires specialist approval in accordance with § 17 Para. 2 BbgFischG.
