Conditions for setting up a nationwide system for the disposal of sales packaging

If you want to operate a nationwide system for the disposal of sales packaging, you need official approval.
The highest state authority responsible for waste management or the authority designated by it will determine, upon your application, that the system has been established nationwide.

The determination can subsequently be provided with ancillary provisions which are necessary to ensure that the conditions existing when the determination is issued are also permanently guaranteed during the operation of the system. The determination must be publicly announced and is effective from the date of public announcement.

Once the determination has been made, you must ensure the regular collection of used, empty sales packaging from private final consumers or in their vicinity free of charge throughout the specified catchment area. You must recycle the packaging collected in your collection system in accordance with the legal requirements. Several systems can work together to set up and operate their systems.

Informal application

as well as suitable evidence in accordance with Section 6 (3) of the Ordinance on the Avoidance and Recycling of Packaging Waste (Packaging Ordinance (VerpackV)) such as

• Extract from the commercial register,
• Proof of area coverage,
• Disposal contracts with disposal companies,
• declaration of coordination,
• safety declaration,
• Proof of membership of the Joint Body,
• Proof of recycling routes
