Anyone wishing to operate a nationwide system for the disposal of sales packaging requires official approval.

If you want to operate a nationwide system for the disposal of sales packaging, you need an official permit.

In accordance with Section 7 (1) of the German Packaging Act (VerpackG), manufacturers of sales packaging filled with goods that typically accumulate with private end consumers are obliged to participate in a system (known as a dual system). This system is responsible for the collection, sorting and recycling of packaging on behalf of the obligated parties. The systems must be set up nationwide and require approval from the competent authority.

The approval can subsequently be provided with ancillary provisions that are necessary to ensure that the conditions that existed when the determination was made are also permanently guaranteed during the operation of the system.

Once approval has been granted, you must guarantee the regular collection of used, empty sales packaging from private final consumers or in their vicinity free of charge throughout the specified catchment area. You must recycle the packaging collected in your collection system in accordance with the legal requirements. Several systems may cooperate in setting up and operating their systems.

According to Section 8 (1) VerpackG, the obligation to participate in a dual system may be waived if manufacturers and distributors of sales packaging deliver to sources of waste generation that are treated as equivalent to private households pursuant to Section 3 (11) VerpackG and organize their own collection of their packaging at these sources of waste generation. The operators of these so-called industry solutions must notify the competent authority of their activities.

An application for system approval must be submitted. The application must be submitted to the State Office for the Environment of the State of Brandenburg.

Once it has been determined that the application documents are complete, the application is finally processed.

The applicant receives a system permit or a notice of rejection.

Approval is published by the competent authority.

The processing time is not regulated by law. It depends on the respective scope of the procedure.
