Which catering establishments are considered "temporary", when and under what circumstances do they have to be reported?

A temporary catering business is carried on by a person who, on a commercial basis, for consumption on the spot,

• drinks and/or
• prepared food,

if the restaurant is accessible to everyone or certain groups of people and is only operated temporarily for a specific occasion, such as a festival, anniversary or other occasion.

Anyone wishing to temporarily operate a catering business on a case-by-case basis must notify the competent authority for the place concerned in accordance with Section 2 (2) of the BbgGastG in writing two weeks before the start of the event using the form in accordance with the annex to Section 2 (2) of the BbgGastG (Notification of a Temporary Catering Business - Gagev).

This notification shall also state that:

• which mode of operation it is, and
• whether it is intended to offer alcoholic beverages.

The following operating modes can be considered:

• Snack
• Public house
• Dining
• Tavern and Dining
• Outdoor bar area (beer garden)
• Café
• Bar
• with musical performance
• with dance event
• Ostrich farming

• The notification is made on the "Gagev" form
• Identity card or passport for identification
• Foreigners who are not citizens of an EU member state or an EEA member state require a residence permit from the competent immigration authority, according to which they are permitted to exercise the trade under aliens law

The notification must be made both for the serving of alcoholic and/or non-alcoholic beverages and for the administration of food during temporary activities, such as club parties.

Certificate of receipt of the notification of a temporary catering business: € 32.00 in accordance with the Ordinance on Administrative Fees in the Portfolio of the Minister of Economy, Labour and Energy (MWAEGebO)

The notification must be submitted to the competent authority two weeks before the start of operations.

The following authorities are involved by the Trade Authority:

• Food Inspection Authority
• Lower Building Inspectorate
• Environmental area of independent cities, municipalities and offices
• Tax office

Receipt of the notification at least two weeks before the start of operation

Local regulatory authorities according to § 1 BbgGastGZV.

The tasks of the local regulatory authorities are performed by the offices, the municipalities that are not subject to administrative authority, the association municipalities, the municipalities that are co-administered, the municipalities that are co-administered and the independent cities (§ 3 of the Regulatory Authorities Act – OBG)

This procedure can also be carried out through a "Point of Single Contact". The "Point of Single Contact" is a special service offered by the municipalities and the state for service providers.
