You need a permit under the Infection Protection Act if you, as the responsible person, want to import, export, store, dispense or work with pathogens from Germany.

Exceptions to the permit requirement exist for the following groups of persons or activities:

  • Doctors, dentists and veterinarians who carry out microbiological examinations for the diagnosis of their own patients
  • Persons who carry out microbiological quality assurance work and have the necessary expertise and are exempted from the permit requirement by the competent authority upon application
  • Employees who work under the supervision of a person who has a permit or is exempt from the permit requirement
  • Certain procedures (e.g. sterility tests)

Note: Pathogens within the meaning of the Infection Protection Act are viruses, bacteria, fungi and parasites as well as other pathogens that can cause an infection or communicable disease in humans.

Erforderliche Unterlagen

You can submit the informal application in writing or in person. If you submit the application in writing to the competent authority, it must be signed by hand or provided with a qualified electronic signature.

Data:

  • Proof of graduation (e.g. diploma certificate, if applicable, certificates, doctoral certificate) in certified copy, in the case of completion of a scientific college or university degree with microbiological content, the microbiological contents of the study must be briefly presented informally
  • Proof of competence: Certificate of two years of full-time activity with pathogens by the employer concerned (copy of the permit to work with pathogens from the person under whose supervision the applicant worked full-time)
  • For proof of personal reliability:
    If you are resident in Germany, you will need a certificate of good conduct.
    If you reside abroad, you will need documents from your home country that prove that you have the personal reliability to perform the desired service.

When checking personal reliability, the approving authority may, in individual cases, request further documents in addition to the listed documents that are suitable for making a statement about your personal reliability as an applicant.

Voraussetzungen

Permission to work with pathogens will be granted to you if you have the necessary expertise and have so far proven to be reliable with regard to work with pathogens.

You can prove the required expertise by completing a degree in human, dental or veterinary medicine, pharmacy or a degree in natural sciences or a university of applied sciences with microbiological content as well as at least two years of full-time work with pathogens.

Another full-time activity in the field of bacteriology, mycology, parasitology or virology for at least two years is also recognised as proof of expertise if you have acquired equivalent expertise.

If the requirements are not fully met, the granting of a limited permit may be considered.

Kosten

According to the Fees Act for the State of Brandenburg (GebBbg) in conjunction with the Schedule of Fees of the Ministry of Labour, Social Affairs, Health, Women and Family (GebOMASGF), the fee for granting permission for activities with pathogens pursuant to § 44 IfSG is EUR 330 according to subheading 7.8.5.1.

The documents to be submitted by you must be sent to the State Office for Occupational Safety, Consumer Protection and Health, Dept. of Health, Department G2 Health Reporting/Infection Control, in 15806 Zossen, Wünsdorfer Platz 3.

Bearbeitungsdauer

Promptly up to max. 3 months

Frist

You need permission from the authorities at an early stage so that you can report the commencement of activities with pathogens at least 30 days before the planned date.

Only after the complete documents have been submitted can the processing of the application begin.
