Hazardous waste
Anyone wishing to dispose of hazardous waste as a trader must keep a register or certain certificates and consignment notes.
The register or the evidence to be kept shall provide evidence of the disposal operations of the hazardous waste. The obligation to keep the register applies to producers, owners, collectors, transporters, dealers and brokers as well as all disposers of hazardous waste.
The obligation to keep evidence applies to the same group of people, with the exception of dealers and brokers of hazardous waste.
Non-hazardous waste
For certain non-hazardous wastes, the verification is regulated by ordinance or the competent authority may order that registers or evidence of the whereabouts of non-hazardous waste must also be kept.
In any case, waste disposal companies must also keep a register of the disposal of non-hazardous waste.
Form of verification
As a rule, registers and records of hazardous waste must be kept in electronic form; only in the case of the keeping of registers on the disposal of non-hazardous waste, the electronic form is exempt.
Households
These obligations do not apply to private households.
Information on the required documents can be found in the application form of the disposal certificate.
Proof of disposal is only required by commercial producers of hazardous waste.
ATTENTION: in the states of Brandenburg and Berlin, there is also an obligation to tender hazardous waste!
Fees are charged in accordance with the disposal certificate fee regulations of the states of Brandenburg and Berlin. The main subheadings are:

Further fees are levied within the framework of the Hazardous Waste Disposal Ordinances that apply in parallel
Since 01.04.2010, the verification procedure has to be carried out exclusively electronically (online) on a legal basis. As a rule, you need suitable special software for this. Alternatively, there is a possibility via the online portal https://leanv.zks-abfall.de/LaenderEANV_Web .
The individual procedural steps are:
- Applying for an electronic mailbox
- Filling out the application for proof (waste producers and waste disposal companies)
- Online forwarding of the application to the competent authority
- The authority will decide on your application and respond to it with an online notification
- After receiving the approval notice, waste producers, transporters and waste disposal companies must keep a delivery note (consignment note) online for each individual disposal. This will be sent online to the competent authority after it has been disposed of
All documents are filed in the register of companies involved in disposal
In some federal states, including Brandenburg and Berlin, the provisions of the Hazardous Waste Disposal Ordinances must be observed in parallel with the obligations to provide evidence.

In the state of Brandenburg, the lower waste management authorities of the districts and independent cities are responsible.
The necessary forms are specified in the Verification Ordinance and are provided by the respective software.
All correspondence in the verification procedure takes place online. All messages must be signed with qualified electronic signatures.
Personal appearance is not required.
