Ausnahmegenehmigung Gurtanlege- und Helmtragepflicht: Erteilung

In order to protect road users, the legislator and legislator has prescribed that seat belts must be worn while driving and that protective helmets must be worn when driving motorcycles.

However, it is possible to be exempted from this obligation upon request. The resulting significant security risk shall be borne by the applicant.

An exemption from the obligation to wear seat belts is possible,

• if it is not possible to wear seat belts for health reasons.
• if the applicant's height is less than 150 cm.

An exemption from the helmet wearing obligation is possible,

• if it is not possible to wear a safety helmet for health reasons.

If the conditions for exemption are of a health nature, a medical or specialist certificate must be submitted stating that the exemption to be applied for is absolutely necessary for medical reasons. A diagnosis need not be included in the certificate.
For heights below 150 cm, a medical certificate with the measured height must also be brought.

The decision is free of charge for severely disabled persons.

The exemption is granted revocably and for a limited period of one year - unless the medical certificate states that the exemption must be granted indefinitely, as the state of health will no longer improve.
