Price audits are an important task of the public sector. In 2004, out of 3,655 audits of public contracts nationwide, 24% of the cases were subject to price law. This resulted in savings of around EUR 35 million.
Orders from the Federal Government, the Länder, the municipalities and associations of municipalities as well as other legal entities under public law are examined. In addition to supplies and services - apart from construction services - this also includes rents and leases. Since July 1999, the prices of construction services in accordance with the Construction Price Ordinance (Regulation PR 1/72) have no longer been examined under price law.
Responsibility lies with the neutral price authorities (price monitoring bodies) of the government representations. They are also responsible for cost audits in accordance with funding law.
In the event of differences in the interpretation of test results, the highest price authority of the state of Lower Saxony, the price formation office at the Lower Saxony Ministry of Economic Affairs, Labour and Transport, may be involved.
