The executive committee of a newly founded party must notify the competent authority of its incorporation.

There are no fees.

The competent authority alone examines whether an organisation that submits documents is to be regarded as a party within the meaning of Section 2 (1) of the Political Parties Act (PartG).

A party loses its legal status as a party if it has not participated in either a Bundestag or a Landtag election with its own nominations for six years. Before the election, the respective election committees check whether the party can be admitted to the upcoming election (European, Bundestag, Landtag or local elections).
