If you intend to operate an X-ray facility in connection with the use on animals in veterinary medicine or to make a significant change to the operation, this requires a permit from the competent authority.

Do you intend to operate or substantially change the operation of an X-ray facility in connection with its use on animals in veterinary medicine?

In this case, you must submit an application for approval to the competent authority. You must meet the legal requirements for granting the permit. The necessary evidence must be provided for this.

The application can be submitted online or in paper form.

In addition to the application for a permit, the following documents must be submitted:

1. plans, drawings and descriptions necessary to verify the conditions for authorisation;

2. Information enabling it to be ascertained whether:
(a) the number of radiation protection officers necessary for the safe performance of the activity has been appointed and they have been granted the powers necessary for the performance of their duties;
(b) it is ensured that the equipment is in place and that measures are taken as are necessary in accordance with the state of the art in order to comply with the safety rules;

3. information that makes it possible to check whether the person responsible for radiation protection and the radiation protection officers are reliable and have the necessary expertise in radiation protection,

4. a copy of a radiation protection instruction in accordance with the ordinance pursuant to Section 73

In particular:

• Proof of expertise and, if necessary, updates for the radiation protection officer if there is no radiation protection officer
• Proof of expertise and, if necessary, updates for the radiation protection officer
• Certificate and test report from the expert on the radiation protection test

Authorisation in connection with the use on animals in veterinary medicine shall only be granted if, in addition to the above-mentioned conditions, the applicant or the radiation protection officer appointed by him is licensed as a veterinarian, doctor or dentist or is authorised to practise the veterinary, medical or dental profession temporarily.

The permit is granted if the legal approval requirements according to §§ 13 and 15 StrlSchG are met.

These are fulfilled if:

1. 1. 1. there are no facts from which doubts arise as to the reliability of the applicant, his legal representative or, in the case of legal persons or associations of persons without legal capacity, the persons entitled to represent or manage the company under the law, articles of association or articles of association and, if a radiation protection officer is not necessary, one of the named natural persons has the necessary expertise in radiation protection,
      2. there are no facts from which doubts arise as to the reliability of the radiation protection officers and they have the necessary expertise in radiation protection,
      3. the number of radiation protection officers necessary for the safe performance of the work has been appointed and they have been granted the powers necessary for the performance of their duties,
      4. it is ensured that the persons otherwise involved in the activity have the necessary knowledge and skills with regard to the possible radiation hazard and the protective measures to be applied,
      5. there are no facts from which doubts arise as to the existence of the necessary personnel for the safe performance of the activity,
      6. it is ensured that the equipment is available and that the measures are taken which, in the case of an activity pursuant to § 12 (1) number 4 StrlSchG, are necessary according to the state of the art in order to comply with the protective regulations,
      7. it is not an unjustified type of activity according to a statutory ordinance pursuant to Section 6 (3) of the Radiation Protection Act or if, taking into account a report published pursuant to Section 7 (2) of the Radiation Protection Act, there are no significant doubts as to the justification of the type of activity, and
      8. other provisions of public law.

Authorisation shall only be granted if, in addition to the above-mentioned conditions, the applicant or the radiation protection officer appointed by him is licensed as a veterinarian, doctor or dentist or is authorised to practise the veterinary, medical or dental profession temporarily.

The fee is calculated according to the time spent, but is at least 250 euros.

They shall send the application for authorisation for the operation or substantial modification of the operation of an X-ray facility in connection with the use on animals in veterinary medicine to the competent authority.

Upon receipt of the application and the complete dossier, the competent authority will check whether the conditions for authorisation are met.

After the application has been reviewed by the competent authority, you will receive the decision in the form of a decision.

Finally, you will be sent a notice of costs from the competent authority.
